SC issues second clarification on reserved seat case
Islamabad: The Supreme Court of Pakistan has issued a second clarification regarding the reserved seats case. In this clarification, the court stated that amendments to the Election Act cannot nullify court decisions.
The Supreme Court emphasized that past applications of amendments to the Election Act cannot apply to its rulings. A majority of the judges have ordered that the clarification be sent to the Election Commission.
In its statement, the Supreme Court mentioned that the Election Commission is obligated to implement the court’s decision, and no further clarification was needed following the detailed ruling.
The court further noted that the Election Commission had approached them for an initial clarification, which was subsequently issued. The Supreme Court has included its clarification as part of the detailed decision.
The court clarified that adhering to its decision is mandatory under Article 189. The Pakistan Tehreek-e-Insaf (PTI) and the Election Commission approached the court for this second clarification, while the Supreme Court granted relief in its decision to uphold voters’ rights.
It is important to note that the Supreme Court issued the second clarification in response to requests from the Election Commission and PTI.
